1. Acceptance of Terms

By registering for, accessing, or using the Genogramo app, website, and related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Service.

2. Eligibility & Accounts

To use our Service, you must be 18 years or older or the age of majority in your locality. You agree to:

  • Provide accurate, current, and complete account information.
  • Maintain the security of your password and accept all risks of unauthorised access to your account.
  • Not share your account credentials with anyone else.

You are solely responsible for all activity on your account.

3. Subscriptions, Billing, and Refunds

Free Trial: We offer a 14-day free trial on initial sign-up, which gives you full access to the Service. No credit card is required to start the trial.

Subscriptions: After the trial period, access requires a paid subscription. We offer monthly, quarterly, and annual plans ("Subscription Plan").

Billing: Payments are processed securely via Stripe. By subscribing, you authorise us to charge your payment method for the initial subscription period and any renewal periods.

Refunds: Generally, all fees are non-refundable. You may cancel your subscription at any time; your access will continue until the end of your current billing cycle.

4. Acceptable Use

You agree not to modify, reverse engineer, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Service, except as expressly permitted by these Terms. You agree not to use the Service for any unlawful purpose.

5. Intellectual Property

Genogramo owns all rights, title, and interest in and to the Service, including all intellectual property rights therein. Your use of the Service does not grant you ownership of any content, code, data, or materials you may access on or through the Service.

However, You retain ownership of the data you create (e.g., family maps, notes). Because this data is stored locally on your device using client-side encryption, we have no access to it and claim no rights to it.

6. Third-Party Services

Our Service may contain links to third-party websites or services (e.g., for payments) that are not owned or controlled by Genogramo. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. GENOGRAMO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THE SERVICE.

IN NO EVENT SHALL GENOGRAMO BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

8. Indemnification

You agree to indemnify, defend, and hold harmless Genogramo, its officers, directors, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your Internet account.

9. Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved exclusively in the courts of the United Kingdom.

10. Termination

Termination by You: You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will cease immediately.

Termination by Us: We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Effect of Termination: Upon termination, your access to the Service ceases. As outlined in our Privacy Policy, we may retain a minimised record of your account identity solely to prevent abuse of our free trial offers.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
